Terms of Service

Plain English: Habstack is a habit-tracking app to help you save consistently. You're 18+, you don't abuse the system, you accept that we're not your financial advisor and we don't hold your money. If we ever genuinely fail to deliver, we'll refund you. If we disagree about something, the courts of Mumbai sort it out. That's the spirit; the legal text below makes it formal.

1. Acceptance & eligibility

By installing the Habstack Android app (package com.habstack.app), accessing habstack.in, or otherwise using our services ("Habstack" or the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

You must be at least 18 years of age to use Habstack. By using the Service you confirm that you are 18 or older. If you are under 18, do not install or use Habstack. If we discover that an under-18 user is using the Service we will terminate the account and delete the associated data.

3. Account & authentication

You can use Habstack anonymously by default. To make a purchase or enable cloud recovery, you will be asked to authenticate via Google Sign-In or email one-time password ("OTP"). You agree to:

We grant you a non-exclusive, non-transferable, revocable licence to install and use Habstack on devices you own or control, for personal, non-commercial use, subject to these Terms.

Violations may result in suspension or permanent termination of your account at our sole discretion (see section 10).

Habstack offers paid subscription plans (currently "Plus" and "Family", in monthly and annual cycles) processed through Razorpay. Pricing is shown in the app and on this website in Indian Rupees (INR) inclusive of GST where applicable.

Each subscription is a one-time charge per cycle. It does NOT auto-renew. Your subscription stays active until its expiry date, after which you can choose to purchase another cycle.

Payments are processed by Razorpay Software Pvt Ltd. Your card or UPI details go directly to Razorpay; we do not store them. By making a payment you agree to Razorpay's terms in addition to ours.

We may change prices at any time. Price changes will not affect already-purchased cycles, and we will give at least 30 days' notice via in-app banner before raising prices for future purchases.

See our full Refund Policy for details. Summary: subscription charges are generally non-refundable once a cycle has begun, with exceptions for verified technical failures.

8. Disclaimers — what Habstack is NOT

Habstack is not:

Habstack is a habit-tracking tool. Any savings you transfer to a bank account, mutual fund, or other instrument are between you and that institution. Habstack does not endorse, recommend, or take a fee from any specific savings vehicle. The "estimated returns" shown in the app for liquid funds (when configured) are illustrative figures based on publicly available historical data and are not a guarantee of future performance.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of liability

To the maximum extent permitted by Indian law, in no event shall Habstack, its operator, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of (or inability to use) the Service.

Our total cumulative liability to you for all claims arising from or relating to the Service shall not exceed the total amount you have paid us for subscriptions in the 12 months preceding the claim. If you have not paid anything, our maximum liability is INR 100.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Indian law.

10. Termination & suspension

You may terminate your account at any time via Settings → Delete my data.

We may suspend or terminate your account, with or without notice, if you breach these Terms or if continued service poses risk to our infrastructure, other users, or our legal standing. Where reasonable we will attempt to notify you first and give an opportunity to remedy.

On termination, your right to use Habstack ends. Sections that by their nature should survive termination (Refunds, Disclaimers, Limitation of Liability, Governing Law) survive.

11. Changes to these terms

We may update these Terms from time to time. Material changes will be announced via in-app banner and via email to users with a bound email address. The "Last updated" date at the top of this page always reflects the most recent change. Continued use of Habstack after the effective date of any change constitutes your acceptance of the revised Terms.

12. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of India. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

Before initiating any legal proceeding, you agree to first contact us in good faith via habstack.in@gmail.com and allow us 30 days to attempt informal resolution.
